A California consumer who bought Zenwise Digestive Enzymes and No Bloat supplements says the products didn’t reduce her gas and bloating as promised, and now she’s suing the company.
Plaintiff Carol Scott filed the class action lawsuit against Zenwise LLC in a California federal court, alleging false advertising.
Scott says she bought the Zenwise supplements after because she believed they would give her rapid relief from gas and bloating, due to the packaging and marketing materials.
However, she says the products gave her no relief from her systems as promised.
The Zenwise digestive enzymes supplements include a label indicating they are “FAST ACTING PROBIOTICS” and “Clinically Proven Works in Hours,” Scott says. The Zenwise No Bloat supplement label makes similar claims.
But while the Zenwise products state that they contain ingredients to provide quick relief from gas and bloating, Scott says this is not that case. In fact, she says the products do not contain any ingredients that are effective at treating gas and bloating at all.
Scott’s attorneys hired a medical expert who determined that the Zenwise supplements don’t contain ingredients that are clinically proven to be capable of providing quick gas and bloating relief.
While the products may contain probiotics — beneficial bacteria or yeast that’s good for the gut — they are not a rapid solution for gas and bloating, and any benefits “will arise gradually over time and may not even be noticeable,” the Zenwise class action says.
Zenwise is taking advantage of a cottage industry that has popped up around consumers’ digestive issues, Scott says.
She says gas and bloating are common ailments, with the latter reportedly affecting between 10-30% of people.
Most people never seek medical care for their symptoms for various reasons, and many opt for over-the-counter remedies, the lawsuit says.
“And in response, a whole cottage industry has emerged – offering up over-the-counter solutions that claim to alleviate gas and bloating,” Scott says. Zenwise has tried to tap into that market by offering products that promise to decrease bloating, even if they don’t work.
“The products have been highly lucrative, with the digestive health supplements market reaching approximately $16.5 billion in the U.S. in 2022,” she alleges.
Scott says she would not have purchased the Zenwise supplements, or would not have paid as much for them if she knew they didn’t work as promised.
Zenwise joins a growing number of supplement companies facing legal action. Miracle Moo colostrum supplements are being challenged for alleged false advertising, particularly regarding claims of scientific validation and clinically dosed immunity benefits.
Onnit Labs, co-founded by Joe Rogan, is also defending itself against accusations that its Alpha Brain pills fail to deliver on promises of enhanced memory and focus, despite claims of clinical support.
GNC is also in the legal spotlight, with a class action lawsuit alleging that their "Super Magnesium" pills contain significantly less magnesium than advertised. Now Health Group faces similar allegations, with consumers claiming they were misled about the actual magnesium content in their Magnesium Citrate Softgels.
In the Zenwise class action lawsuit, Scott is suing for a multitude of violations under California law, including unfair competition, false advertising, fraud, and breach of warranty. She is seeking class action certification, damages, legal fees, and a jury trial.
