A Georgia resident who says he received multiple unwanted calls from Xfinity is now suing the company on behalf of anyone in the country who had a similar experience.
Plaintiff Travis Pond filed a class action lawsuit against Comcast Cable Communications LLC, commonly known as Xfinity, on Aug. 11 in a Georgia federal court, alleging the company made illegal robocalls to him and others.
The lawsuit alleges that Xfinity violated the Telephone Consumer Protection Act (TCPA) by placing pre-recorded debt collection calls to people who never had an account with the company.
Pond says he received multiple unwanted pre-recorded calls from Xfinity starting in late 2023.
The calls, which referenced a $300 debt on two accounts, came from phone numbers associated with the company, he said.
However, Pond says he never did business with Xfinity. He said he never consented to the company calling him, and called back to ask the company to stop.
“Despite his requests for the calls to stop, Plaintiff Pond continued receiving unwanted calls from Xfinity,” the lawsuit states.
Robocalls have long been a national nuisance, with millions of complaints filed each year.
According to the Federal Communications Commission (FCC), 4.1 billion robocalls were made in June 2024 alone, averaging 137.6 million calls per day, the lawsuit states.
The TCPA was enacted in 1991 to curb such invasive telemarketing practices, but the problem has escalated in recent years due to the proliferation of autodialing technologies, Pond says.
He claims that Xfinity has reportedly made nearly 2 million calls from the same phone number that contacted him, with numerous online complaints from other consumers who, like Pond, claim they have no connection to the company.
In the Xfinity robocall class action lawsuit, Pond is looking to represent a nationwide class of individuals who received similar calls from Xfinity over the past four years.
He’s seeking certification of the class action, injunctive relief asking the court to order Xfinity to stop making the alleged unwanted pre-recorded calls, damages, fees, costs and a jury trial.
Xfinity is not the only company to face a TCPA class action lawsuit. Walden University recently agreed to pay up to $400 to each claimant after consumers alleged the college violated federal and state telemarketing laws by making unsolicited calls to consumers who had requested not to be contacted.
