A new lawsuit claims that Straight Smile LLC’s Byte Aligner Systems and Impression Kits are not only ineffective but also pose serious risks to consumers.
The lawsuit, filed in Florida, accuses Byte and its parent company, Dentsply (owned by Straight Smile LLC) of false advertising and failing to disclose known dangers associated with their teeth-straightening products.
These dangers allegedly include allergic reactions, bite misalignment, bone loss, and the breaking and chipping of teeth, as well as choking due to poor-fitting aligners, cuts on their gums from the aligners’ sharp edge, facial swelling, abscesses in the mouth, gum recession, flaring of teeth, and more.
Paula J. Phillips, a Florida attorney, filed the proposed class action lawsuit saying she was misled by Byte’s marketing into believing she was purchasing a safe and effective alternative to expensive orthodontic treatments. After seeing an advertisement for Byte Aligners in April 2024, Phillips paid over $3,300 for the product.
However, she says, her experience quickly turned sour. Within weeks of using the aligners, Phillips reported severe pain and bleeding in her mouth. The situation worsened until she was forced to stop using the product. When she sought a refund, she was met with Byte’s strict no-refund policy.
Only months later, in February 2025, did she learn that Byte had abruptly suspended sales of its aligners the previous October due to regulatory concerns. Yet, the company never reached out to customers like her to offer compensation or warnings about potential risks.
Byte heavily markets itself as a budget-friendly alternative to traditional orthodontics, promising a dentist-overseen treatment at a fraction of the cost. However, the lawsuit alleges that Byte’s process lacks essential medical oversight. Unlike Invisalign and other reputable brands, Byte allows customers to purchase and use its products without an initial assessment by a dentist or orthodontist.
The company’s promotional materials claim, “Your treatment plan is reviewed and prescribed by a dentist,” but the lawsuit says this is misleading. Customers were allegedly left without proper monitoring, leading to severe dental problems, including jaw misalignment, gum recession, and even tooth loss.
Between 2020 and 2024, more than 500 complaints were filed with a federal medical database, detailing a range of serious complications such as locked jaws, fractured teeth, and allergic reactions. Despite these alarming reports, Byte continued to market its products as safe and effective, failing to implement a system to track and report adverse events properly.
Byte isn’t the only company facing legal scrutiny over misleading claims and faulty products with several beauty and wellness brands are under fire for allegedly deceiving customers.
Hydrafacial LLC is facing a class action lawsuit over its Syndeo machine, which consumers say is riddled with design flaws that cause persistent clogging and malfunctions and e.l.f. Cosmetics has been accused of using oversized packaging to mislead customers into believing they were getting more product than they actually were.
Meanwhile, RoC Skincare is under fire for allegedly misrepresenting the benefits of its Retinol Rinse-Off Cleanser, which, according to a lawsuit, fails to deliver promised anti-aging effects and HiSmile and other beauty brands have also been sued for exaggerated marketing claims, including misleading before-and-after images and deceptive ingredient labeling.
In her lawsuit against Straight Smile LLC, Phillips wants to represent anyone in Florida who purchased a Byte Aligner System and Impression Kit.
