You are part of the Class Action Settlement Class if you provided your personal data to FFCU and were notified of potential impact due to the Data Incident between January 17, 2022, and February 6, 2022.
Excluded from the Settlement Class are FFCU’s officers and directors, as well as:
(i) Settlement Class Members who request exclusion from the Settlement Class in a timely and valid manner.
(ii) Judges assigned to the Litigation and those assessing the fairness of the settlement.
(iii) Individuals found guilty under criminal law of perpetrating, aiding, or abetting the Data Incident, or who plead nolo contendere to such charges as determined by a court of competent jurisdiction.

Plaintiff Brenda Briscoe filed the class action lawsuit against FFCU, alleging the credit union's failure to secure and protect her and approximately 229,748 other individuals' personally identifiable information (PII). This information includes names, addresses, Social Security numbers, driver's license or government ID numbers, financial account details, and credit or debit card information.
FFCU, a New Mexico credit union headquartered in Albuquerque, New Mexico, and with branches throughout the state, experienced a Data Breach between January 17, 2022, and February 6, 2022. During this time, unauthorized individuals gained access to FFCU's network systems and acquired files containing the PII of the plaintiff and other class members.
The lawsuit alleges that FFCU is responsible for the Data Breach and asserts claims including negligence, negligence per se, breach of fiduciary duty, breach of implied contract, breach of express contract, and violation of the New Mexico Unfair Trade Practices Act. The plaintiffs seek compensation for all individuals affected by the Data Breach.
FFCU denies all claims made by the plaintiffs and maintains its innocence, asserting that it did not engage in any wrongful conduct.
