Choice Health TCPA Settlement: $7M

The Class Action Settlement includes the following class that the Court certified: all persons throughout the United States to whom Choice Health Insurance, LLC placed, or caused to be placed, a call where:

(1) the call was directed to a telephone number registered on the National Do Not Call Registry for at least 30 days

(2) Digital Media Solutions, LLC provided Defendant with the telephone number (but excluding telephone numbers that Zeeto Group provided to Digital Media Solutions, LLC and that Digital Media Solutions, LLC then provided to Defendant)

(3) the telephone number had at least two calls placed to it in a 12-month period

Choice Health Insurance has agreed to a $7 million class action settlement to resolve accusations of violating the federal Telephone Consumer Protection Act (TCPA) by initiating unsolicited phone calls.

The class action settlement applies to individuals who received at least two calls from either Choice Health LLC or Digital Media Solutions LLC, acting on behalf of Choice Health, to numbers registered on the National Do Not Call Registry within a span of 12 months.

Lead plaintiff Juanita Williams brought allegations that Choice Health breached the Federal Telephone Consumer Protection Act (TCPA) through unsolicited telemarketing calls to numbers registered on the National Do Not Call Registry. However, Choice Health refutes these allegations.

As per the settlement terms, members of the class will share an equal portion of the net settlement fund. While the precise payments hinge on the number of valid claim forms received, each class member could potentially receive up to an estimated $33.79.

Moreover, Choice Health has pledged to terminate its association with the vendor responsible for providing the phone numbers utilized for the unsolicited calls, Digital Media Solutions.
