Plaintiffs Samuel Bingaman, William Swigert, Shane Wilson, Rosalie Dupus, and Maria Ruskiewicz brought a class action lawsuit complaint against Avem, alleging that a Data Security Incident potentially exposed personal identifying information (PII) and protected health information (PHI), including names, Social Security numbers, and health insurance details.
Avem, a provider of financial and technology solutions to rural hospitals, was entrusted with the PII/PHI of Plaintiffs and Settlement Class Members. Following the Data Security Incident on May 16, 2022, affecting approximately 271,303 individuals, Avem notified Plaintiffs and the Settlement Class on December 12, 2022.
Under the proposed Settlement, Avem will pay $1,450,000.00 into a Settlement Fund. This fund will cover notice and administration costs, attorneys' fees and expenses, service awards for class representatives, and Settlement Fund taxes. The Net Settlement Fund will provide payments and benefits to eligible Settlement Class Members.
Reimbursement for Lost Time and Out-of-Pocket Expenses: Settlement Class Members who spent time responding to the Data Security Incident may be compensated for Lost Time at $25.00/hour, up to 5 hours. Additionally, those with financial losses attributable to the Incident may claim reimbursement for Out-of-Pocket Expenses.
Identity Theft and Credit Monitoring: All Settlement Class Members (excluding those opting for an Alternative Cash Payment) are entitled to three years of identity theft protection and credit monitoring, including identity theft monitoring, alerts, and fraud resolution services.
Alternative Cash Payment: Settlement Class Members may opt for a one-time Alternative Cash Payment of $100.00 instead of reimbursement for Out-of-Pocket Losses, Lost Time, and/or Credit Monitoring and Identity Theft Protection Services.
Confirmatory Discovery: Avem will provide documents and information to show the measures taken to address the Data Security Incident and enhance information security practices.
