You are a Settlement Class Member if ACTS Retirement Services, Inc. (“ACTS”) identified you as being among those individuals impacted by the Data Security Incident, including all who were sent a notice of the Data Security Incident.
The Settlement Class specifically excludes: (i) ACTS; (ii) the Related Entities; (iii) all Settlement Class Members who timely and validly request exclusion from the Settlement Class; (iv) any judges assigned to this case and their staff and family; and (v) any other Person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Data Security Incident or who pleads nolo contendere to any such charge.

Plaintiffs and former employees Cara-Aimee Corra and Valarie Hanna alleged that the assisted-living provider ACTS Retirement Services demonstrated negligence in safeguarding the sensitive information of both employees and residents, resulting in cybercriminals infiltrating ACTS's network.
The exposed information included names, addresses, Social Security numbers, dates of birth, financial account numbers and routing numbers, as well as medical treatment or diagnosis details of both current and former patients and employees.
Following preliminary approval from a federal court, ACTS Retirement–Life Communities based in Fort Washington, PA, has agreed to pay $1 million to settle allegations that it failed to protect the personal information of 20,754 individuals. This includes 18,276 former ACTS employees and 2,478 current or former residents affected by a data breach in April 2022.
The Data Security Incident was brought to light in April 2022. Upon discovering the breach, ACTS sent notifications to individuals potentially impacted by the breach in July and October 2022. Subsequently, this lawsuit was filed, asserting claims against ACTS related to the data breach.
ACTS Retirement Services maintains its denial of any wrongdoing in this matter.
