Parking Company Class Action: Did They Illegally Access Your DMV Data?

Lawsuit Claims Personal Information Used for Parking Tickets without Consent

A parking company has been slapped with a class action lawsuit alleging it illegally obtained personal information from motor vehicle records without consent, and then used the data to send parking tickets to people’s homes.

Plaintiff John Samuel Brooks filed the class action complaint against Parking Revenue Recovery Services Inc. Aug. 13 in a Florida federal court, alleging violations of the Driver’s Privacy Protection Act (DPPA)

Parking Company Accused of Illegally Obtaining Personal Data from DMV

According to the complaint, Parking Revenue Recovery Services operates private parking lots throughout Florida, and uses license plate recognition cameras to track vehicles. 

The company then allegedly requests personal data, such as names and home addresses, from state Department of Motor Vehicle (DMV) records to issue parking notices. 

Brooks says this practice violates the DPPA, a federal law enacted in 1994 to protect the privacy of licensed drivers by limiting the use and distribution of personal information stored in DMV records.

Plaintiff Received Parking Ticket With Personal Information, Lawsuit Claims

The lawsuit states that on May 5, 2022, Brooks parked his car in a lot managed by the parking company in Jacksonville, Florida. 

Two weeks later, he received a letter demanding an $80 payment for a parking charge. 

The notice included photographs of his car’s license plate, which the company allegedly captured using its surveillance system. Brooks says that he never provided his personal information to the parking company and that it was obtained by cross-referencing his license plate with DMV data, without his authorization.

Class Action Seeks Damages for Privacy Violations

Brooks claims the company's use of his personal information to issue the parking notice was not allowed under the DPPA.  

As a result, he’s seeking to represent all U.S. residents whose personal information was allegedly obtained and used by Parking Revenue Recovery Services over the past four years. The lawsuit alleges that the company’s actions resulted in harassment, invasion of privacy, and annoyance for Brooks and others affected by the unauthorized data collection. 

Brooks is seeking certification of the class action, $2,500 damages for each class member, fees, costs and a jury trial.

In 2020, data broker LexisNexis reached a settlement of over $5 million to end class action claims under the DPPA that the company sold DMV data to law firms, which then used it for their own business purposes.
