Nutrisystem Accused of Secretly Sharing Customer Data Without Consent

Consumers Claim Nutrisystem Secretly Tracked Their Online Activity and Shared Personal Information

Nutrisystem customers may have unknowingly shared more than just their weight-loss goals. A recently filed lawsuit claims the company sent personal data to a third-party marketing firm without permission, tracking users across the internet.

Plaintiff Amelia Ingrao says she had no idea her information was being shared until she received an unexpected email from a marketing service called SafeOpt after visiting Nutrisystem’s website. She argues that Nutrisystem never disclosed this data-sharing practice and that consumers should have had the option to opt out.

Marketing Technology Tracks Shoppers Without Consent

Ingrao’s complaint claims that Nutrisystem allowed AddShoppers, a web-tracking company, to collect visitor data without customer approval. AddShoppers allegedly builds detailed profiles by tracking people across different sites, using the information to target them with ads.

The lawsuit argues that this type of tracking goes beyond basic marketing. SafeOpt, a service run by AddShoppers, reportedly connects data from multiple online stores, revealing what users browse and buy. Some of those businesses sell highly personal products, raising concerns about how much information is being shared.

“Among many other privacy concerns, SafeOpt’s network of business includes companies that sell highly personal products,” the lawsuit states. “As a result, SafeOpt can reveal exceptionally private information about customers to anyone that shares a computer.”

Ingrao says she never agreed to this type of tracking. She is now seeking damages for affected customers and wants Nutrisystem to change how it handles user data.

Customers May Have Had No Idea This Was Happening

People expect some level of advertising when they visit a website, but this case suggests Nutrisystem shoppers may not have known their browsing activity was being monitored so closely. The lawsuit claims that personal details were collected and linked across multiple platforms, creating profiles without user permission.

For customers buying health and wellness products, the stakes may be even higher. The lawsuit argues that personal shopping habits could be exposed to third parties, increasing the risk of unwanted marketing, data misuse, or privacy concerns.

“Consumers are harmed every time their information is used without their consent,” the lawsuit claims.

More Businesses Under Fire for Data Tracking

Nutrisystem isn’t the only company facing questions about privacy.

Last week, Allstate was accused of secretly collecting driving data through third-party apps and selling it to other businesses. The lawsuit claims millions of Americans had their location and driving habits monitored without permission.

In January, CVS came under legal scrutiny for allegedly allowing an analytics firm to track mobile app users without disclosing the practice. The complaint alleges that sensitive information, including names, addresses, and prescription details, was intercepted and stored.

Ingrao’s lawsuit aims to represent California residents whose information was allegedly collected by AddShoppers while visiting Nutrisystem’s website. She is asking the court to require Nutrisystem to be transparent about its data collection practices and give customers a clear way to opt out.

The lawsuit also seeks compensation for those affected, arguing that Nutrisystem’s practices violated consumer privacy laws.
