NFL Enterprises Hit with Class Action for Unwanted Texts

NFL Sends Unsolicited Texts, Violating Consumer Privacy Laws, Lawsuit Says.

In the world of professional football, not all surprises come from the field. NFL Enterprises finds itself at the center of a class action lawsuit for bombarding consumers with unsolicited text messages. Melissa Chrum, the plaintiff, alleges that despite her clear demand for NFL Enterprises to cease their intrusive text messages, the company continued to send promotional content.

Ignoring the stop signal

Chrum's ordeal began in September 2023 when she received an unexpected text from NFL Enterprises promoting its YouTube and YouTubeTV channels. Despite responding with a "stop" to cease the unwanted communications, Chrum alleges that the messages kept coming, a clear signal to her that something was amiss in NFL Enterprises' respect for consumer rights.

The lawsuit accuses NFL Enterprises of not adhering to the Telephone Consumer Protection Act (TCPA), which mandates maintaining a do-not-call list and respecting consumers' opt-out decisions, reports Law360. Chrum's situation, receiving texts despite being on the National Do-Not-Call registry, suggests a systematic issue within the NFL's marketing strategies.

Chrum seeks to hold NFL Enterprises accountable for its telemarketing practices, demanding a jury trial and aims to include anyone in the U.S. who experienced similar unwanted NFL text messages.

A recurring issue?

This isn't the first time NFL Enterprises has been accused of intrusive marketing practices. A similar lawsuit was filed in January 2023, criticizing the NFL for its alleged practice of dispatching automated text messages to consumers without their permission. However, that case saw an abrupt end when the plaintiff voluntarily dismissed it in April 2023.

The NFL unwanted texts class action lawsuit is Chrum v. NFL Enterprises LLC, Case No. 1:24-cv-02163, in the U.S. District Court for the Southern District of New York.
