KemperSports, a leading golf course and hospitality management company, is facing a class action lawsuit after a significant data breach exposed the personal information of tens of thousands of individuals. 

The company, which manages over 140 golf courses, private clubs, sports venues, and resorts, is accused of failing to protect its customers' sensitive data, allowing cybercriminals to access highly personal information, including Social Security numbers. 

“Defendant breached this duty and betrayed the trust of Plaintiff and Class members,” the lawsuit states.

KemperSports Accused of Negligence In Data Breach, Putting Customers At Risk

Rachel Getzinger, a resident of McHenry County, Illinois, filed the proposed class action lawsuit against KemperSports, alleging negligence and more. She received a notice from the company in September 2024, informing her that her Social Security number had been exposed in the data breach, according to the lawsuit. 

Getzinger says she takes great care protecting her personal information and had never previously been a victim of such an attack. The breach has caused her significant distress, forcing her to take time to investigate the breach, monitor her financial accounts, and protect herself from potential identity theft, the lawsuit alleges.

Getzinger, along with others in the class action, argues that KemperSports failed to live up to its responsibility to protect their personal information. The lawsuit alleges that the breach has already resulted in identity theft risks, and the plaintiffs will be forced to deal with these dangers for the rest of their lives. 

The complaint further claims that KemperSports failed to provide adequate security measures, exposing its customers to unnecessary harm.

Data Breach Exposed Personal Information of Over 62,000 Individuals

KemperSports detected the breach in early April 2024, after noticing suspicious activity on its computer network, according to the lawsuit. A forensic investigation revealed that cybercriminals had infiltrated its systems and accessed files containing the personal information of over 62,000 individuals. 

Among the data exposed were names and Social Security numbers, which are highly valuable to cybercriminals for identity theft and fraud.

The lawsuit alleges that KemperSports was negligent in failing to implement adequate cybersecurity measures, such as encryption and timely detection of the breach. Furthermore, it accuses the company of delaying the notification to affected individuals, which added to the harm caused. 

By the time the breach was disclosed, it’s believed that the stolen information had already been sold or marketed on the dark web, putting the victims at even greater risk.

Cyberattacks On the Rise Despite Record Spending On Cybersecurity

The KemperSports breach is part of a broader trend of rising cyberattacks. According to the Identity Theft Resource Center, over 1 billion data breach victims were reported in the first half of 2024 alone—a staggering 409% increase compared to the same period in 2023. The rise in breaches comes despite record spending on cybersecurity, with global investments expected to reach nearly $215 billion in 2024.

Cybercriminals are evolving their tactics, particularly through ransomware attacks that not only lock up victims’ data but also steal it. Cloud misconfigurations, another growing issue, have exposed large amounts of corporate and personal data, further fueling the rise in breaches.

Companies Face Legal Action Over Data Breaches and Privacy Violations

The lawsuit against KemperSports is just one of many data breach-related class actions. Hospital Sisters Health System is also facing a lawsuit after patient data was compromised in a cyberattack. 

Similarly, Toshiba and HealthEquity have been sued over breaches that exposed sensitive information. In another high-profile case, genetic testing company 23andMe settled a data breach lawsuit for $30 million after customer information was stolen.

In the KemperSports data breach class action lawsuit, Getzinger wants to represent consumers from across the U.S. in her claims of negligence, breach of implied contract, and unjust enrichment. She’s seeking damages, injunctive relief, fees, and costs.
