A lawsuit filed by Jessica Desir, Ty-nice Norman-Robinson, and Sherine Parker claims that the frozen chicken nuggets contain synthetic additives despite packaging that advertises them as “100% All Natural” with “No Artificial Ingredients.”
The complaint states that the company behind Yummy Dino Bites, Maxi Canada Inc., misled consumers into believing they were purchasing a cleaner, healthier option. The plaintiffs argue that the product contains isolated soy protein and xanthan gum, two ingredients that do not meet the definition of natural.
Food labels play a major role in purchasing decisions, especially for those looking to avoid processed additives. The lawsuit claims that Maxi Canada Inc. used branding to target health-conscious buyers who are willing to pay more for products they believe contain only simple, whole ingredients.
“Defendant’s labeling and advertising puts forth a straightforward, material message: the Products contain only ingredients that are natural,” the complaint states.
The lawsuit centers on the claim that Yummy Dino Bites contain substances that require extensive processing and do not align with the expectations of consumers who purchase foods labeled as free from artificial ingredients.
According to the plaintiffs, isolated soy protein and xanthan gum should not be classified as natural ingredients.
Isolated soy protein is used in many processed foods to enhance texture, increase protein content, and help retain moisture. Extracting it involves multiple chemical steps, including the use of hexane, a synthetic solvent. The lawsuit argues that this process disqualifies it from being considered “100% All Natural.”
Xanthan gum, a thickening agent found in various packaged foods, is produced through fermentation and later treated with isopropyl alcohol. The lawsuit cites FDA regulations that classify xanthan gum as a synthetic substance, contradicting the product’s claim of containing no artificial ingredients.
The lawsuit states that Maxi Canada Inc. benefited financially by charging a premium for a product marketed as free from artificial ingredients. Desir, Norman-Robinson, and Parker claim that they relied on the company’s statements when deciding to purchase Yummy Dino Bites and would not have paid the same price had they known about the ingredients.
Desir, who bought the nuggets from Stop & Shop in Brooklyn, New York, said she purchased the product under the assumption that it contained only natural ingredients. Norman-Robinson made a similar purchase at Target, believing the same. Both later discovered that the product contained ingredients they had sought to avoid.
Disputes over misleading ingredient claims have become increasingly common in the food industry.
In December, Smartfood popcorn faced a lawsuit over marketing that claimed its product contained “No Artificial Flavors” and “No Artificial Preservatives.” Plaintiffs allege that the popcorn includes maltodextrin, an ingredient classified as synthetic and used as both a preservative and a flavoring agent.
Other recent cases include Walmart’s Parent’s Choice Yogurt Bites, which are marketed as preservative-free but contain ascorbic acid, and CVS Health gummy supplements, which advertise the absence of artificial preservatives despite containing synthetic citric acid.
