The complaint, filed on June 20, 2024, in the US District Court for the Eastern District of California, takes aim at the supplement's marketing promises and the questionable science behind them.

"Clinically Studied" PMS Supplement Didn't Work, Lawsuit Claims

Haylah Deas, the lead plaintiff from Chico, California, argues that Semaine's advertising and packaging mislead consumers into believing the supplement is scientifically validated and effective at rapidly relieving common PMS symptoms. The lawsuit contends that Semaine's claims are false and the product - a blend of ashwagandha, Boswellia, curcumin, and other ingredients – fails to deliver on its promises at the advertised dosages and regimen.

Deas details how Semaine portrays PMS & Period Support as a science-backed solution, using terms like "clinically studied" and "clinically proven" to promote rapid relief of cramps, bloating, mood swings, and inflammation. The lawsuit highlights that these claims are prominently displayed on the product's packaging, website, and even Amazon listings.

Consumers Call Out False Advertising for Semaine PMS Supplement

The lawsuit argues that the "clinical study" Semaine cites lacks credibility. Deas alleges the study, conducted by Citruslabs, was inadequate and doesn't validate the supplement's effectiveness or support the marketing claims. The complaint points out that Citruslabs itself raises red flags by promoting itself as a service that can help companies "create the necessary evidence" to support health claims for dietary supplements, suggesting a potential lack of scientific rigor in their studies.

Additionally, Deas’ complaint argues that an advertiser’s health-related claims about the efficacy of a product must “be supported with ‘competent and reliable scientific evidence,” which the Federal Trade Commission (the “FTC”) defines as “‘tests, analyses, research, studies, or other evidence based on the expertise of professionals in the relevant area, that have been conducted and evaluated in an objective manner by persons qualified to do so, using procedures generally accepted in the profession to yield accurate and reliable results.’”

Class Action Demands Refunds for "Useless" Semaine Supplement

Deas claims she was misled by Semaine's marketing and purchased the supplement based on the belief it would effectively target her PMS symptoms, specifically bloating. The lawsuit states that after using the product as directed, Deas experienced no improvement and ultimately discarded the remainder of the bottle.

“Had Ms. Deas known that PMS & Period Support was not proven to be effective to relieve PMS symptoms, she would not have purchased it or, at the very least, would not have paid the premium charged for it as a “natural” product,” the lawsuit states. 

Deas' experience is likely shared by many other consumers who purchased the supplement based on the allegedly deceptive marketing claims, particularly those emphasizing "as needed" rapid relief. Disgruntled customers have reportedly complained about the product's ineffectiveness and high cost on platforms like Amazon.com and Target.com.

In the Semaine Health PMS supplement class action lawsuit, Deas aims to hold Semaine accountable for its alleged misleading advertising and provide compensation to consumers who were allegedly deceived into purchasing the ineffective supplement. She is asking for restitution for all funds acquired by Semaine through these alleged deceptive practices, plus pre- and post-judgment interest. Additionally, the lawsuit seeks compensatory damages, statutory penalties, and punitive damages.
