Milo’s Poultry Farms sold eggs contaminated with Salmonella, a harmful bacteria that can cause serious illness, that caused more than dozens of people across the country to get sick, a new lawsuit alleges.
The lawsuit claims that all carton sizes of “Milo’s Poultry Farms” and “Tony’s Fresh Market” branded eggs were unsafe for consumption but were sold without any warning about the risk and that Milo’s failed to notify consumers of the contamination, violating state and federal laws and causing financial losses to those who purchased the eggs under the assumption they were safe.
Joel Abdullah, a South Carolina resident, filed the proposed class action lawsuit accusing Milo’s negligence, unjust enrichment, breach of warranty, and more. Abdullah purchased the eggs on September 2, unaware of any risk, according to the lawsuit, and four days later, a nationwide recall was announced. The recall came after 65 people across nine states reported illnesses linked to the eggs, with 24 requiring hospitalization.
Abdullah alleges he would not have purchased the eggs—or would have paid less—had he known about the contamination. The lack of transparency, he claims, left him and other consumers with unsafe products that did not meet basic food safety expectations.
On September 6, Milo’s Poultry Farms issued the recall of its branded eggs after the FDA found evidence of Salmonella in environmental samples. The contaminated eggs had been distributed nationwide, with most cases reported in Wisconsin and others in California, Illinois, and several additional states.
The recall highlighted the risks posed by Salmonella, which can cause severe symptoms including fever, diarrhea, nausea, and vomiting. Vulnerable groups such as children, elderly individuals, and those with weakened immune systems face an increased risk of life-threatening complications.
Salmonella is a bacteria that causes salmonellosis, a common foodborne illness. Symptoms typically appear six hours to six days after infection and can last up to a week. While most cases resolve without treatment, severe infections may require hospitalization.
The bacteria are transmitted through contaminated food, water, or contact with infected animals. Infections are becoming harder to treat due to antibiotic-resistant strains, underscoring the importance of proper food handling and transparency in recalls.
Milo’s is not the only company facing legal action over food safety. Boar’s Head settled a lawsuit this year after its deli meats were linked to a listeria outbreak that caused 10 deaths. Badia Spices faces allegations of selling lead-contaminated cinnamon, and McDonald’s is battling claims tied to E. coli outbreaks from contaminated onions in its burgers.
These cases reflect growing scrutiny of food producers and their responsibilities to safeguard consumer health.
In his lawsuit against Milo’s Poultry Farms, Abdullah wants to represent consumers nationwide in his claims of unjust enrichment, breach of warranty, fraudulent concealment, negligence, and more. He is seeking injunctive relief, restitution, damages, interest, fees, and costs.
