Case Alleging Misleading Claims Due to PFAS in Packaging Concludes

The class action lawsuit against Kerrygold butter, alleging misleading "pure" branding due to the presence of "forever chemicals" in its packaging, has been dismissed.

Last Wednesday, U.S. District Judge Frederic Block granted the dismissal with prejudice on August 14th, following a joint request from the plaintiff and Ornua Foods North America Inc., Kerrygold's parent company. The terms of the dismissal remain confidential, with both parties agreeing to cover their own legal costs.

The lawsuit, initially filed by Carolyn Winans, claimed that Kerrygold's packaging contained PFAS (perfluoroalkyl and polyfluoroalkyl substances), chemicals linked to potential health risks. Winans argued the "pure Irish butter" label was misleading due to the alleged presence of PFAS.

The case initially gained traction earlier this year when Judge Block allowed it to proceed, but the recent dismissal marks an end to the litigation. The specifics of the dismissal remain undisclosed.

In the complaint, Winans argued that Kerrygold's "Pure Irish Butter" label was misleading as PFAS, known to be harmful to humans and the environment, were present in the product. The lawsuit highlighted that Kerrygold butter had been pulled from shelves in New York and California due to PFAS in its packaging, violating regulations in those states. It further contended that Ornua Foods intentionally used the "Pure Irish Butter" description to boost sales, misleading health-conscious consumers.

Winans asserted that consumers wouldn't have purchased the product had they known about the presence of these synthetic chemicals. The Kerrygold butter lawsuit also pointed to diet as a major source of PFAS exposure and the associated health risks, including reproductive issues, developmental concerns in children, and an increased risk of certain cancers.
