Lifted Liquids, Inc., the company behind Urb-branded delta-8 and delta-10 THC vape products, faces serious allegations of false advertising. The class action lawsuit claims the company misrepresented its products as containing less than 0.3% delta-9 THC, the legal limit under federal law. However, independent testing reportedly revealed much higher levels, raising concerns about safety, legality, and consumer trust.
Josue Hernandez of Florida and Sergio Hernandez of Texas filed the lawsuit, saying they purchased the products believing they were legal and safe. Instead, they argue, the mislabeled items exposed them to unanticipated risks, including failed drug tests, potential legal trouble, and stronger psychoactive effects than expected.
Products marketed under the Urb brand featured packaging claiming they contained less than 0.3% delta-9 THC, a critical threshold that distinguishes legal hemp products from marijuana under federal law. These assurances led consumers to believe they were buying compliant items that offered stress relief without the intoxicating effects of traditional cannabis.
Laboratory testing, however, allegedly uncovered that many of the products contained delta-9 THC levels far exceeding the legal threshold. The testing results directly contradict the claims printed on the packaging, according to the allegations.
Josue Hernandez purchased Urb products in 2023 and 2024 from Florida retailers. He sought relief after work and chose these items based on assurances they complied with the law and offered mild effects. Sergio Hernandez, who purchased similar products in 2022 in Texas, made his decisions for the same reasons.
The plaintiffs describe risks that extend beyond misleading labeling. Failed workplace drug tests, probation violations, or even legal penalties in states where marijuana remains illegal are real possibilities for consumers unaware of the actual THC content. They also emphasize the unintended psychoactive effects, which could lead to safety risks like driving while impaired.
“Plaintiffs reviewed and relied on the Products’ packaging before buying it, including the representation that the Products contained less than 0.3% delta-9 THC. If Plaintiffs had known the Products were falsely labeled and in fact contained a higher level of delta-9 THC than the legal limit, Plaintiffs would not have bought the Products,” the complaint argues.
Delta-8 and delta-10 THC products exploded in popularity after the 2018 Farm Bill legalized hemp-derived cannabinoids. These alternatives appealed to consumers looking for milder effects or legal options in states where traditional cannabis is prohibited. The rapid growth of the market has, however, raised concerns about transparency and regulation, as seen in this case.
In the Lifted Liquids class action lawsuit, the plaintiffs are seeking damages, refunds, and court orders to stop Lifted Liquids from continuing its current labeling practices. They are calling for the company to relinquish profits obtained through what the plaintiffs describe as deceptive business practices.
