Amazon has been hit with a class action lawsuit alleging the retail giant used deceptive pricing practices to sell its popular Fire TV products.
Plaintiff David Ramirez filed the class action complaint against Amazon.com, Inc. on Sept. 12 in a Washington federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Amazon falsely inflated the “List Prices” of Fire TV models to create the illusion of large discounts.
Ramirez alleges that Amazon consistently advertised the Fire TV products with a strikethrough "List Price" and a significant percentage discount.
However, the lawsuit claims these "List Prices" were often inflated and did not reflect actual prices, leading shoppers to believe they were getting a time-limited bargain.
Ramirez says Amazon violated Washington’s Consumer Protection Act by using these allegedly misleading pricing tactics.
The lawsuit argues that the falsely advertised discounts led consumers to pay more for the Fire TV products than they otherwise would have, thinking they were getting a better deal.
The lawsuit references a similar 2021 judgment in California, where Amazon was barred from using false or misleading "List Prices" in its advertising.
“Amazon, the largest online retailer in the United States, is a repeat and willful offender,” Ramirez states.
His case highlights how the listed prices were often not in use for at least 90 days before the so-called discounts, making the savings appear more significant than they actually were.
Ramirez is looking to represent anyone who purchased one or more Fire TVs when those TVs had not been sold at the list price within the prior 90 days.
He is suing for breach of contract and violations of state and federal consumer laws, and is seeking certification of the class action, damages, fees, costs and a jury trial.
If successful, the case could result in compensation for thousands of consumers who purchased Fire TV products, believing they were receiving deep discounts.
Last month, a federal judge gave the green light to a class action lawsuit alleging Amazon subscriptions to services like Prime and Kindle are way too difficult to cancel, allowing it to proceed.
