Walgreens Prescription Savings Club Settlement: $100M

Consumers and entities who:

• Purchased one or more prescription drugs from Walgreens between Jan. 1, 2007, and Nov. 18, 2024, and

Walgreens has agreed to a $100 million settlement to resolve claims that it overcharged insurers and customers for prescription drugs by inflating its "usual and customary" prices.

The lawsuit alleges that Walgreens failed to include the discounted prices from its Prescription Savings Club (PSC) when calculating the “usual and customary” cost of prescription drugs. This omission reportedly caused insurers and other third parties to reimburse Walgreens for more than they should have, and the increased costs were passed on to customers who used insurance to pay for their prescriptions.

While Walgreens denies any wrongdoing, the pharmacy chain agreed to settle the claims to avoid further litigation.

What Does the Settlement Provide?

1. Cash Payments for Consumers and Entities:

   • Eligible individuals can receive a proportional share of 20% of the net settlement fund based on what they paid for prescriptions during the class period.
   • Third-party payors, such as insurers, will share 80% of the net settlement fund, also based on their prescription drug payments during the class period.

2. Payment Distribution:

   • Payments will vary depending on how much was paid for eligible prescriptions and the total number of claims filed.
