Progressive Michigan Total Loss Settlement: $61M

• Policyholders with a Progressive Marathon Automobile Insurance Policy in Michigan who received a total loss payment for a vehicle claim between July 18, 2013, and July 22, 2024.
  
  
• Policyholders with a Progressive Michigan Automobile Insurance Policy who received a total loss payment for a vehicle claim between July 18, 2016, and July 22, 2024.

Policy or claim numbers may be required to complete a claim.

Progressive Michigan Insurance Co. and Progressive Marathon Insurance Co. will pay a $61 million settlement to resolve allegations that they excluded required fees from total loss payouts.

The class action lawsuit alleged that Progressive failed to include sales tax, title fees, and vehicle registration transfer fees when calculating compensation for total loss vehicle claims. Policyholders argued that these fees were part of the agreement and should have been covered in payouts.

Although denying any liability, Progressive agreed to the settlement to bring closure to the case.

Class members are entitled to cash payments proportionate to the fees they should have received, including:

• Sales tax
• Certificate of title fees
• Vehicle registration transfer fees

Payments will vary based on the number of claims submitted and deductions for administrative and legal fees.

Eligible policyholders will need to file a claim by Dec. 6, 2024. Proof of purchase, such as policy or claim details, may be required. Payments will be distributed either as direct account credits for current policyholders or as mailed checks for former policyholders.
