New York City has agreed to pay $17.5 million to settle a class action lawsuit alleging the New York City Police Department (NYPD) engaged in discriminatory practices by unlawfully removing religious head coverings from individuals during arrest processing for mugshot photos.
The lawsuit, filed in 2018, argued that these practices violated the First Amendment's protection of religious freedom. It further claimed violations of the Religious Land Use and Institutionalized Persons Act (RLUIPA), a federal law that prohibits government restrictions on religious exercise unless those restrictions are justified by a compelling government interest and implemented in the least restrictive way possible. Additionally, the lawsuit cited violations of specific New York state laws protecting religious expression.
Plaintiffs argued that the NYPD mandated the removal of all head coverings for mugshot photos, regardless of religious significance. This policy allegedly forced individuals who wore religious head coverings, such as hijabs, turbans, or yarmulkes, to remove them during booking procedures. The lawsuit argued that these forced removals were humiliating and disrespectful to the religious beliefs of those arrested.
While New York City maintains that its policy complied with lawful procedures for identification purposes, they agreed to the $17.5 million settlement to avoid the costs and uncertainties of a lengthy court battle. The settlement applies to anyone arrested by the NYPD between March 16, 2014, and August 23, 2021, who was forced to remove a religious head covering for their mugshot photo.
The total settlement fund is $17.5 million. The amount each eligible person receives will depend on the total number of claims filed. It is estimated that each claimant may receive $7,824 or more, but the final amount could be higher or lower depending on participation.
To receive a settlement payment, a valid claim form must be submitted by September 26, 2024.
