Duty Free Shops (DFS), a well-known retailer operating duty-free stores in airports and other travel hubs across the United States, has agreed to a $2.5 million settlement to resolve a class action lawsuit alleging violations of the Fair and Accurate Credit Transactions Act (FACTA).
FACTA is a federal law enacted in 2003 to protect consumers from identity theft. Among its provisions, FACTA restricts the way businesses can print credit card information on receipts. Specifically, it prohibits businesses from printing more than the last four digits of a customer's credit or debit card number.
The lawsuit against DFS claimed that the company violated FACTA by printing receipts at some of its stores that displayed both the first six and last four digits of customers' credit card numbers. This practice, the lawsuit argued, increased the risk of identity theft if a receipt was lost or stolen. DFS maintained they did not violate FACTA but agreed to the settlement to avoid the costs and uncertainties of a lengthy court battle.
The settlement applies to all U.S. residents who made purchases at a DFS store between May 27, 2020, and June 30, 2022, using a credit or debit card and received an electronic receipt showing the first six digits and last four digits of their card number.
The following Duty Free Shops locations are included in the settlement:
While the total settlement fund is $2.5 million, the amount each individual receives will depend on the total number of valid claims submitted. It is estimated that each class member will receive no more than $17.00.
