Alaska Airlines and Horizon Air have agreed to pay $4.75 million to resolve claims that they violated the Uniformed Services Employment and Reemployment Rights Act (USERRA) by failing to compensate pilots for short-term military leave. The lawsuit alleges that the airlines paid pilots for other forms of short-term leave—such as jury duty, bereavement leave, and sick leave—but refused to pay for military leave, which plaintiffs argue is discriminatory and violates federal law.
The plaintiffs claim that this policy created financial and professional hardships for pilots who served in the military. By failing to provide pay for military leave, Alaska Airlines and Horizon Air allegedly treated military service as less important than other obligations, contrary to the protections USERRA provides.
Alaska Airlines and Horizon Air deny the allegations but have agreed to the settlement to resolve the claims without admitting wrongdoing. Under the settlement, class members will receive compensation based on the amount of military leave they took, ensuring that affected pilots are compensated for their unpaid leave and provided with future paid military leave benefits.
Eligible class members may receive:
Cash Payment: Payments will vary based on the amount of short-term military leave each pilot took.
Future Paid Military Leave: Up to four days per calendar year of short-term military leave will be paid at the hourly wage going forward.
No action is required for pilots who took short-term military leave between Oct. 10, 2004, and May 31, 2023, at Alaska Airlines or Oct. 2, 2008, and May 31, 2023, at Horizon Air. Pilots who took leave at Horizon Air between Oct. 10, 2004, and Oct. 2, 2008, must submit a valid claim form by Dec. 20, 2024.
