Walgreens has agreed to pay a settlement to resolve a class action lawsuit alleging violations of the Fair Credit Reporting Act (FCRA). The lawsuit claimed Walgreens failed to properly notify job applicants about background checks before denying them employment.
The lawsuit alleged Walgreens violated the FCRA by sending emails to job applicants that did not meet the legal requirements before denying them employment based on background checks. The FCRA requires employers to provide applicants with a copy of the background check and information about their rights to dispute it before taking any adverse action, such as not hiring them.
The settlement applies to anyone who applied to work at Walgreens between March 30, 2020, and May 17, 2022, and was denied a job based on a background check. They must have also received one or both of the specific emails Walgreens sent out regarding background checks.
While Walgreens denies any wrongdoing, they agreed to pay $2.25 million to settle the lawsuit. All eligible class members will receive at least $100. Some may be eligible for an additional payment of up to $818.28 if they intended to dispute their background check but were discouraged by the email they received from Walgreens.
