A class action lawsuit filed in February 2021 against TransAm Trucking has been settled for $3.75 million. The lawsuit alleged that the trucking company violated the Fair Labor Standards Act (FLSA) by failing to properly compensate its drivers in several ways.
Specifically, the lawsuit made the following claims:
- Company Driver Orientation Claim: Drivers were not paid the federal minimum wage of $7.25 per hour for all hours worked during mandatory orientation programs held in Rockwall, Texas, or Tampa, Florida, between October 2020 and March 2021.
- Lease Driver Minimum Wage Claim: TransAm allegedly misclassified lease drivers as independent contractors, denying them minimum wage protections for all hours worked under the FLSA.
- Truth-in-Leasing Claim: The lawsuit further alleged that TransAm failed to comply with Truth-in-Leasing regulations. These federal regulations require motor carriers to clearly disclose deductions made from drivers' compensation in independent contractor agreements. This includes expenses, insurance, and escrow funds.
TransAm Trucking denies all allegations and maintains they paid their drivers properly. However, to avoid the costs of further litigation, they agreed to the settlement. The court has not issued a decision on the merits of the case.
The $3.75 million settlement offers compensation to eligible class members, but the breakdown is not equal for all claims.

Company Driver Orientation Claim: Those who attended driver orientation will receive a pro-rata share of a $125,000 settlement fund. While each member will receive at least $35, the exact amount depends on the total number of valid claims submitted.

Lease Driver Minimum Wage Claim & Truth-in-Leasing Claim: The settlement does not provide automatic compensation for these claims. However, by participating in the settlement, class members give up their right to sue TransAm Trucking over these specific allegations.
