SunWest Milling and SunWest Foods have agreed to a $1.2 million settlement to resolve claims that they violated California wage and hour laws. The lawsuit alleges that the companies failed to:
- Pay minimum and overtime wages.
- Provide required meal and rest periods.
- Deliver timely and accurate wage statements.
- Pay wages on time upon termination of employment.
The plaintiffs argue that these practices violated California labor laws, including the Private Attorneys General Act (PAGA), which allows workers to sue on behalf of the state’s labor board for wage and hour violations.
SunWest, while denying wrongdoing, has agreed to the settlement to resolve these claims.
Eligible class members will receive a pro rata payment based on their individual workweeks during the class period. The net settlement amount will be divided by the total number of workweeks worked by all participating class members, and the resulting amount will be multiplied by the workweeks of each member.
Additional PAGA Compensation:
Members of the PAGA class will receive an additional pro rata share of the settlement’s PAGA fund.
No Claim Form Required:
Class members do not need to file a claim form to receive benefits. However, they can contact the settlement administrator to dispute the workweek/pay period estimates included in their mailed notices by Dec. 23, 2024.
This settlement provides financial compensation for alleged wage and hour violations while ensuring compliance with California labor laws moving forward.
