A settlement has been reached to resolve claims that P.F. Chang’s underpaid its servers, violating federal labor laws. The settlement benefits current and former servers who worked at P.F. Chang’s locations in various states between November 5, 2016, and July 8, 2020, and who opted into the lawsuit by the designated opt-in deadline.
The class action lawsuit alleged that P.F. Chang’s paid its servers low wages and relied on tips to supplement their income. However, servers were reportedly required to perform significant side work that did not generate tips, leading to pay below the federal minimum wage, which violates the Fair Labor Standards Act (FLSA). P.F. Chang’s, a popular restaurant chain specializing in Asian and Chinese cuisine, has not admitted any wrongdoing but agreed to settle the claims to avoid further litigation.
Under the terms of the settlement, class members will receive cash payments based on the hours they worked for which they were paid below minimum wage, as determined by their work hours and earnings history. The settlement was granted preliminary approval on August 15, 2024, but no final approval hearing has been scheduled yet.
Class members must return a claim release form by October 25, 2024, to receive payment. No proof of purchase or additional documentation is required to file a claim.
Payments will vary based on the hours worked and earnings history of each eligible server, with exact amounts determined by the net settlement fund after deductions for fees and costs.
