Zales TCPA Settlement: $7.54M

Individuals in the U.S. who:

• Did not provide their phone number to Zale Delaware Inc.,

• Received two or more Zales marketing text messages within a 12-month period, and

• Had their residential or cellular number registered on the National Do Not Call Registry for at least 30 days before receiving the messages.

Zales has agreed to a $7.54 million class action settlement to resolve claims that it violated the federal Telephone Consumer Protection Act (TCPA) by sending unsolicited telemarketing text messages to people who had not given their numbers to the company.

The class action lawsuit alleged that Zales sent marketing texts to individuals whose phone numbers were listed on the National Do Not Call Registry (NDNCR) and without the required consent. This would constitute a direct violation of the TCPA, which aims to protect consumers from unwanted robocalls and texts.

Zales denies any wrongdoing but chose to settle the case to avoid further litigation.

What Class Members Can Receive

Class members who submit a valid claim form may receive:

• Cash Payment:
  Estimated up to $100 per person. The final amount will depend on the number of valid claims submitted and the net settlement fund remaining after legal and administrative fees.
