Viva Aerobus has agreed to a $3.95 million settlement to resolve claims that it recorded customer service calls without informing callers. This settlement is open to California residents who made or received recorded calls to or from Viva Aerobus’s customer service department between August 7, 2022, and November 10, 2023.
The class action lawsuit alleges that Viva Aerobus, a low-cost Mexican airline, violated California laws by recording calls without first obtaining consent. Plaintiffs claim that the airline’s failure to notify customers of the recording violated California’s strict call recording laws. Viva Aerobus denies any wrongdoing but agreed to the settlement to resolve the claims.
Class members who qualify will receive an equal share of the net settlement fund. Payments are estimated to be $21.45 per call but could reach up to $100 per qualified call, depending on the number of valid claims and other factors. Eligible individuals must submit a valid claim form by November 9, 2024, to receive a share of the settlement fund.
