UnitedHealthcare agreed to pay $2.5 million to settle a class action lawsuit claiming the company violated the Telephone Consumer Protection Act (TCPA) by placing unsolicited robocalls to non-members.
The lawsuit accused UnitedHealthcare of using automated dialing systems and prerecorded messages to call individuals who had no relationship with the company. Plaintiffs argued these calls were made without prior express consent, which is required under the TCPA for telemarketing or informational calls made using automated technology.
The calls reportedly came from several UnitedHealthcare teams, including the Medicare and Retirement Non-Licensed Retention Team, the Community and State National Retention Team, and the Medicare and Retirement Collections Team. These teams allegedly used the Avaya Pro Contact and LiveVox IVR systems to place the calls.
The plaintiffs claimed they were not UnitedHealthcare members and had no existing business relationship with the company, meaning the calls were both unwanted and illegal under federal law.
UnitedHealthcare has denied any wrongdoing but agreed to settle the case to avoid further litigation.
This settlement provides compensation to individuals who received unwanted robocalls and gives UnitedHealthcare a chance to move past the dispute without admitting wrongdoing.
