Speedway has agreed to a $12,122,775 class action settlement to resolve allegations that it violated Illinois' Biometric Information Privacy Act (BIPA) by collecting employee fingerprints without proper notice or consent.
The lawsuit claims that the company required employees to use a finger scanner to clock in and out of shifts, but failed to:
Inform them in writing that biometric data was being collected,
Disclose the specific purpose and duration of data retention,
Obtain a written release prior to collecting or storing the data.
Although Speedway denies wrongdoing, it agreed to settle to avoid further litigation.
Each eligible class member will receive an equal share of the net settlement fund, with estimated payments of around $970 per person. Actual payment amounts may vary depending on the total number of participants.
No action is needed for eligible individuals. Benefits will be distributed automatically unless someone opts out.
