Receivables Performance Management Data Breach Settlement: $5.6M

All individuals who were sent notification by RPM that their Personal Information was or may have been compromised in the April 2021 data incident.

To claim reimbursement for documented losses, you will need to provide supporting documentation such as account statements, credit reports, communication charges, travel expenses, tax records, or other evidence of data breach-related expenses.

A class action lawsuit against RPM has been settled for $5.6 million following a data security incident in April 2021, which allegedly exposed the personal identifying information (PII) of affected individuals. Plaintiffs claim RPM failed to implement reasonable security measures to protect the PII. RPM denies any wrongdoing but has agreed to settle to avoid further litigation.

Under the terms of the settlement, eligible class members can receive the following benefits:

1. Reimbursement for Attested Time and Out-of-Pocket Losses:

   • Attested Time: Up to 4 hours of time spent responding to the data incident, compensated at $25/hour (subject to a $100 cap).
   • Out-of-Pocket Losses: Reimbursement for financial losses traceable to the data incident, including identity theft, costs incurred for credit monitoring, and other miscellaneous expenses. There is no cap for out-of-pocket loss claims.

2. Credit Monitoring Services:

   • All settlement class members are eligible for 3 years of identity theft protection and credit monitoring services, including alerts, three-bureau credit monitoring, fraud resolution, and identity theft insurance coverage.

3. California Statutory Damages Payment:

   • California residents in the subclass may file a claim for an additional cash payment estimated at $50.

4. Residual Credit Monitoring Services:

   • If funds remain in the Settlement Fund after initial payments, all settlement class members who filed for credit monitoring services will receive up to a total of 5 years of credit monitoring services.

5. Residual Cash Payment:

   • If funds remain after residual credit monitoring services are provided, all settlement class members who filed a valid claim will receive a residual cash payment of up to $100.

To receive these benefits, settlement class members must submit a valid Claim Form by November 12, 2024.
