Plaintiffs Jasmyn Bickham and Amanda Bailey filed a class action lawsuit against ReproSource Fertility Diagnostics, alleging that the company failed to safeguard patients' sensitive information during a cyber-attack in August 2021. The breach exposed personal data of approximately 350,000 individuals, including Social Security numbers, names, email addresses, dates of birth, health insurance details, and treating physician information.
Despite the breach occurring in August, the fertility center did not notify affected individuals until October 2021 - nearly two months after the security incident. Plaintiffs and other class members alleged they faced various repercussions, including unauthorized credit card charges, identity theft, and fraudulent financial activities.
ReproSource has denied any wrongdoing but has agreed to a $1.25 million settlement to address the allegations raised in the class action lawsuit. The settlement applies to individuals whose personal information was compromised in the August 2021 data breach and who received notification of the breach in October 2021.
Under the terms of the settlement, class members can claim reimbursement for losses incurred due to the breach, including up to $3,000 for expenses such as unreimbursed fraudulent charges, credit monitoring costs, professional fees, and miscellaneous expenses. Additionally, class members can opt for three years of Credit Monitoring and Insurance Services (CMIS), which include credit bureau monitoring and $1 million in identity theft insurance. Alternatively, they can choose to receive a flat cash payment of approximately $50.
Residents of California who submit a claim may be eligible for an additional $50 payment.
