QuoteWizard has agreed to a $19 million class action settlement to resolve claims that it violated the Telephone Consumer Protection Act (TCPA) by sending unwanted telemarketing text messages to consumers registered on the National Do Not Call Registry.
According to the lawsuit, QuoteWizard sent repeated marketing texts to individuals without their consent, even though their phone numbers were on the federal Do Not Call list. This practice allegedly violated consumer privacy rights and disregarded TCPA guidelines that protect consumers from unsolicited communications.
QuoteWizard is an online insurance comparison platform that connects consumers with insurance providers. The company markets its services via text messages, calls, and other methods, which led to complaints from consumers who said they received repeated texts despite requesting not to be contacted.
Under the terms of the settlement, class members are eligible to receive a cash payment based on the number of texts received from QuoteWizard. Payment details are structured as follows:
$76 minimum for individuals who received two qualifying texts
$38 per additional text beyond the first two
For example, someone who received four unwanted texts would be eligible for a payment of $152.
Payments may be adjusted depending on the total number of valid claims, but the structure guarantees at least $76 for class members who received the minimum number of texts to qualify.
Consumers who meet the eligibility criteria will automatically receive a settlement payment unless they choose to exclude themselves from the settlement. This structure makes it easier for affected individuals to receive compensation without filing additional paperwork.
In addition to financial relief, the settlement holds companies accountable for respecting consumer privacy and reinforces protections against unwanted marketing communications.
