Timekeeping company NOVAtime has agreed to a $4.2 million settlement to resolve a class action lawsuit alleging violations of Illinois' Biometric Information Privacy Act (BIPA).
BIPA is a state law that regulates the collection, use, storage, and disposal of biometric identifiers, such as fingerprints and facial scans. The lawsuit claimed that NOVAtime collected individuals' fingerprint data without providing written notice or obtaining written consent, as required by BIPA.
The settlement benefits individuals who used a NOVAtime-branded fingerprint scanner time clock in Illinois between August 14, 2014, and October 19, 2020. Each eligible class member is expected to receive around $248.90 from the settlement fund, though the final amount may vary depending on the number of claims submitted.
While NOVAtime denies any wrongdoing, they have agreed to the settlement to resolve the lawsuit. There is no deadline to file a claim, allowing eligible individuals to receive their share of the settlement automatically.
The lawsuit was filed in 2019 by plaintiff Timothy Thome, who alleged that his employer and NOVAtime failed to obtain proper consent or provide notice regarding the collection and storage of his fingerprint data, as required by BIPA.
