Nations Direct Mortgage (NDM) has agreed to resolve claims from a 2023 data breach through a class action settlement that provides financial compensation and credit monitoring to affected individuals.
The lawsuit alleged that NDM failed to implement sufficient cybersecurity protections, allowing an unauthorized party to access its systems in December 2023. The breach allegedly compromised sensitive information including Social Security numbers, birth dates, and other personal identifiers.
While NDM has denied wrongdoing, it has agreed to settle the case by offering financial reimbursements and services to those affected.
Eligible class members can receive up to $2,750 in reimbursement for documented losses linked to the breach. These may include fraudulent charges, identity theft-related losses, bank fees, and other out-of-pocket expenses. Additionally, claimants may be compensated for up to two hours of lost time at $25 per hour, with a cap of $50.
Class members who resided in California at the time of the breach may also receive an additional $75 statutory payment.
All class members are eligible for two years of free credit monitoring, which includes real-time credit file monitoring, dark web surveillance, $1 million in identity theft protection, and more.
To receive compensation, class members must submit a valid claim form by January 7, 2026. The deadline to exclude yourself or object to the settlement is December 23, 2025, and the final approval hearing is scheduled for January 22, 2026.
