When you text "stop" to a company, you expect the messages to actually stop. A class action lawsuit alleged Kaiser Permanente didn't always get the message. The health care giant has agreed to pay $10.5 million to settle claims that it continued sending marketing texts to consumers who had already opted out.
Kaiser Foundation Health Plan operates as one of the largest health care organizations in the country, serving millions of members primarily on the West Coast.
Like many companies, Kaiser uses text messaging to communicate with current and prospective customers. The lawsuit took issue with what happened after people tried to end those communications.
Federal law under the Telephone Consumer Protection Act gives consumers the right to stop receiving marketing texts by replying with "stop" or similar language.
Once someone opts out, companies are required to honor that request. According to the lawsuit, Kaiser kept sending messages anyway, bombarding some consumers with repeated texts they had clearly indicated they didn't want.
Florida residents face an additional layer of protection under the state's Telephone Solicitation Act, which imposes stricter requirements on companies sending marketing texts. A separate subclass covers Floridians who received messages more than 15 days after opting out.
Kaiser has denied violating either the TCPA or FTSA and hasn't admitted any wrongdoing. The company agreed to the settlement to resolve the litigation.
Unlike many class action settlements that offer flat payments, this one rewards claimants based on how many unwanted texts they received.
Each qualifying message is worth up to $75. If you received three texts after opting out, you could receive up to $225. Someone who received ten messages might be eligible for as much as $750. The more times Kaiser ignored your opt-out request, the larger your potential payment.
There's one caveat: if the total value of approved claims exceeds the $10.5 million settlement fund, payments will be reduced proportionally. Everyone would still receive compensation based on their message count, but the per-message rate would drop below the $75 maximum.
To qualify, you must have received more than one text from Kaiser Foundation Health Plan during the eligibility period after sending a "stop" request or similar opt-out instruction.
Florida residents have a slightly different standard—they qualify if texts arrived more than 15 days after opting out.
Claims must be submitted by Feb. 12, 2026. The deadline to exclude yourself or file an objection is Dec. 29, 2025. A final approval hearing is set for Jan. 28, 2026.
