Jefferson Dental, operating as JDC Healthcare Management, has agreed to pay a $1,000,060 settlement to resolve claims that it unlawfully sent text messages to consumers who had opted out of receiving them. The settlement benefits U.S. residents who received texts from Jefferson Dental after making a “STOP” request and after placing their cell number on the National Do-Not-Call Registry between May 17, 2019, and May 17, 2023.
The class action lawsuit alleges that Jefferson Dental violated the Telephone Consumer Protection Act (TCPA), a federal law that requires businesses to obtain express written consent before sending promotional texts. The lawsuit claims that Jefferson Dental continued to send promotional “spam” text messages, even after recipients requested to opt out. Jefferson Dental denies any wrongdoing but agreed to the settlement to resolve the claims.
The settlement provides an estimated $57 cash payment to eligible class members who file valid claims by the deadline. Payments will be distributed via check within 60 days of the settlement's final approval, pending any appeals.
The settlement covers an estimated 10,334 people. Class members must file a valid claim form online or by mail by December 9, 2024, to receive payment.
