Google's Android operating system is installed on billions of mobile devices worldwide. A class action lawsuit, Taylor, et al. v. Google LLC, alleged that Android devices were transferring information to Google in the background without user permission—even when devices were idle and not actively in use. These data transfers consumed users' cellular data, costing them money on their wireless plans.
The plaintiffs argued that Google could have configured these background transfers to occur only when devices were connected to Wi-Fi but instead chose to use cellular data networks. This unauthorized consumption of paid cellular data allegedly violated consumer protection laws and required Google to compensate affected users.
While Google has not admitted any wrongdoing, the company agreed to a $135 million class action settlement to resolve the allegations. The settlement also includes non-monetary benefits: Google will update its Google Play Terms of Service, its Help Center pages, and the setup screens shown to Android users during device setup to disclose the data transfer practices and obtain user consent. Google will also disable a related setting on Android devices.
Class members are eligible to receive a cash payment from the $135 million settlement fund. The exact payment amount will depend on the total number of participating class members and the amount each member paid for cellular data while using Android devices. There are approximately 100 million class members, and each qualifying member is expected to receive the same amount. If funds remain after the initial distribution, they may be redistributed to previously paid class members. No remaining funds will be returned to Google.
