Gifted Healthcare has reached a settlement in a class action lawsuit stemming from a 2021 data breach where the company's email systems were infiltrated by unknown parties, resulting in the unauthorized access of sensitive personal information belonging to thousands of prospective, current, and former employees.
The lawsuit alleges that between August 25 and December 10, 2021, Gifted Healthcare's email systems were compromised, exposing the personal data of approximately 11,317 individuals, including names, Social Security numbers, and financial account details.
Despite Gifted Healthcare not admitting to any wrongdoing, victims of the data breach have reported facing numerous challenges, including fraudulent attempts to open bank accounts, diminished credit scores, and financial losses associated with mitigating the effects of the incident. The lawsuit contends that the breach has left the plaintiff and the class vulnerable to further misuse, fraud, and identity theft by cybercriminals.
Plaintiff Cheryl Covington, a former certified nursing assistant at Gifted Healthcare in Oklahoma City, states that employees were required to provide sensitive personal information upon hiring, including bank account details for payroll purposes. The lawsuit alleges that Gifted Healthcare failed to adequately safeguard the vast amount of personal information it possessed, thereby breaching its legal obligation.
Gifted Healthcare reportedly began notifying data breach victims around August 24, 2022, after discovering suspicious activity related to an employee email account. Despite claiming no evidence of misuse, the company offered complimentary credit monitoring and identity theft protection services.
The proposed settlement provides affected individuals with options to enroll in three years of credit monitoring and identity theft protection services or receive compensation for ordinary losses, lost time, and extraordinary losses related to the data incident. Alternatively, class members may opt for a $50 alternative cash payment.
