Fathom Realty TCPA Settlement: $2.85M

Consumers who received more than one text message from former Fathom Realty agent Marcus Edwards between Aug. 15, 2021, and Dec. 15, 2024, while their phone number was registered with the National Do Not Call Registry for at least 30 days.

Fathom Realty has agreed to pay $2.85 million to resolve allegations that it sent unsolicited text messages in violation of the Telephone Consumer Protection Act (TCPA).

The lawsuit targeted messages sent by former Fathom Realty agent Marcus Edwards. Plaintiffs claim they received repeated promotional texts even after their phone numbers had been listed on the National Do Not Call Registry for more than 30 days—a direct violation of the federal telemarketing law. The TCPA requires telemarketers to have prior written consent to contact individuals on the registry.

Fathom Realty is a national real estate company with operations across the U.S. While the company denies any wrongdoing, it chose to settle the lawsuit to avoid the cost and risk of ongoing litigation.

Under the terms of the settlement, class members can receive an estimated $48 for each text message they received. Payments may be adjusted depending on the number of claims submitted, but eligible individuals may receive compensation for multiple messages.

To qualify, class members must submit a valid claim form by January 7, 2026. The deadline to exclude yourself or object to the settlement is also January 7, 2026, and the final approval hearing is scheduled for February 6, 2026.
