Everything Breaks has agreed to pay $995,000 to resolve a class action lawsuit alleging the company repeatedly violated the Telephone Consumer Protection Act (TCPA) with unsolicited telemarketing calls to numbers listed on the National Do Not Call Registry.
The class action lawsuit claims that Everything Breaks disregarded federal telemarketing laws by repeatedly calling consumers whose numbers were explicitly listed as "Do Not Call" in the company’s internal records or who had already asked to be placed on the company's internal do-not-call list. Plaintiffs say these repeated calls were illegal and invaded their privacy.
The TCPA was created to give consumers control over unwanted telemarketing calls, particularly to phone numbers on the National Do Not Call Registry. Telemarketers are prohibited from calling consumers who have been on the registry for at least 31 days, and companies must also maintain and honor internal do-not-call requests from individuals who explicitly ask not to be contacted.
Everything Breaks is a warranty provider that offers coverage plans for electronics, appliances, vehicles, and more. While the company maintains it did nothing wrong, it chose to settle the case to avoid further legal costs and uncertainty.
Class members who submit a valid claim form will receive a cash payment representing an equal share of the available settlement amount. Exact payments will depend on the total number of valid claims. According to court filings, eligible class members could receive an estimated $36 to $144 each.
Class members do not need to submit phone records to qualify. Eligibility will be confirmed by comparing submitted phone numbers to internal lists maintained by Everything Breaks.
Payments may be adjusted higher or lower depending on how many valid claims are filed.
This settlement does not affect your ability to pursue other claims you may have against Everything Breaks for unrelated issues.
