DaVita Inc. has settled a $3.8 million lawsuit over claims that its use of third-party web tracking tools improperly disclosed sensitive data. The settlement resolves allegations that patients' personally identifiable information (PII) and protected health information (PHI) were shared with third parties, including Facebook and Google, without proper consent.
The lawsuit accused DaVita of enabling these disclosures through tracking and analytics technologies embedded in its online platforms. Patients allege this data was used to monitor their interactions with DaVita’s digital services, violating privacy expectations. While DaVita denies any legal violations, it opted to settle to conclude the legal process.
Eligible participants can receive:
- Privacy Shield Services: A one-year subscription to a data protection and monitoring service designed to help safeguard against identity theft.
- Cash Payments: A pro rata share of the settlement fund. The amount depends on how many claims are filed, with payment amounts distributed after fees are covered.
To take part in the settlement, you must file a claim by Dec. 4, 2024. No documentation is required to submit a claim for payment or services.
