Change Healthcare has agreed to a $1.67 million settlement to resolve claims that it violated the Telephone Consumer Protection Act (TCPA) by making robocalls and prerecorded calls to consumers on behalf of Blue Cross Blue Shield of North Carolina (BCBSNC). The calls were allegedly made to individuals who were not BCBSNC customers or who had opted out of receiving such calls.
The class action lawsuit claimed that Change Healthcare, operating under the brand My Advocate, contacted consumers through robocalls and prerecorded messages for BCBSNC. The lawsuit alleges that these calls violated the TCPA because they were made to individuals who had not subscribed to BCBSNC services or had opted out of receiving these communications.
Both Change Healthcare, a healthcare payment cycle management company, and BCBSNC, a North Carolina-based insurance provider, deny any wrongdoing. However, they agreed to the $1.67 million settlement to resolve the claims and avoid further litigation.
To receive settlement benefits, class members must submit a valid claim form by December 2, 2024. Claimants must provide the telephone number that received the robocalls or prerecorded messages to verify their eligibility. The exact payout amount for each claimant will be determined based on the number of valid claims filed and the net settlement fund available after fees and expenses are deducted.
