Mobile payment service Cash App has agreed to pay $12.5 million to settle allegations that it illegally sent marketing texts to Washington residents.
The lawsuit accused Cash App, operated by Block, Inc., of violating Washington’s Commercial Electronic Mail Act (CEMA) and Consumer Protection Act (CPA). According to the complaint, Cash App users were encouraged to share pre-filled referral messages with their contacts. These texts, the plaintiffs argued, amounted to unsolicited commercial messages because recipients never gave express permission to receive them.
This practice allegedly placed recipients in the same category as victims of spam or robocalls, which Washington law strictly limits. CEMA, in particular, requires opt-in consent for commercial texts and allows statutory damages for violations.
While Cash App denies any wrongdoing, the company chose to resolve the matter with this settlement instead of continuing to litigate the claims in court.
Eligible individuals who file a valid claim will share equally in the net settlement fund. Current estimates suggest payouts will fall between $88 and $147 per person, but the exact amount depends on how many people submit claims. Payments will be distributed by check or electronic transfer once the settlement is finalized.
