Behavioral Health Group (BHG) has agreed to a $1.575 million settlement to resolve claims that it failed to protect patient data during a December 2021 cyberattack.
In the data breach class action lawsuit, plaintiffs claimed that BHG, an outpatient opioid addiction treatment provider, did not implement adequate cybersecurity measures to protect patient data from the December 2021 breach. They argued that BHG could have prevented or mitigated the breach by taking reasonable precautions. Although BHG has not admitted any wrongdoing, it agreed to settle the claims to avoid further litigation.
Class members can receive reimbursement for expenses related to the data breach:
Class members claiming unreimbursed losses are also eligible for two years of free credit monitoring and identity theft protection services, which include three-bureau monitoring and $1 million in identity theft insurance. Those without documented losses or who prefer not to claim them can opt for an alternative cash payment, estimated to be around $150, with a cap of $250 depending on the number of claims filed.
Eligible individuals must submit a valid claim form by October 23, 2024.
