American Income Life Insurance Company has agreed to a $14 million settlement to resolve allegations that it violated the Telephone Consumer Protection Act (TCPA) by making repeated unsolicited telemarketing calls to consumers registered on the National Do Not Call Registry.
The lawsuit alleged that the company made repeated calls to consumers without their consent, even after those individuals had taken steps to avoid such contact by registering their numbers.
The plaintiff, who was not an American Income Life customer, reported receiving multiple calls, disrupting her daily life and causing frustration.
The TCPA prohibits businesses from contacting consumers with marketing calls if they’ve been listed on the National Do Not Call Registry for over 30 days and have not given permission to be contacted. The plaintiff claimed American Income Life failed to comply with these federal guidelines.
American Income Life, which offers a range of life insurance policies for individuals and businesses, denies any wrongdoing but agreed to settle to avoid further litigation.
Class members who file a valid claim form will be compensated on a pro rata basis, meaning those who received more calls from American Income Life will receive a larger share of the net settlement fund.
Exact payment amounts have not yet been determined and will depend on the total number of valid claims submitted. The $14 million fund will be divided among approved claimants after administrative and legal costs are deducted.
