A class action lawsuit filed against Wahlburgers, the popular restaurant chain co-founded by actor Mark Wahlberg, has resulted in a $2 million settlement. The lawsuit alleged that Wahlburgers misled consumers with the labeling of their pickle products, specifically "Fresh Dill Spears," "Fresh Dill Chips," and "Fresh Dill Chips Hot."
The class action lawsuit centered on three key claims displayed on the Wahlburgers pickle packaging: "fresh," "all natural," and "no preservatives." Plaintiffs argued that these labels were deceptive because the pickles contained sodium benzoate, a synthetic preservative that extends shelf life. The lawsuit contended that these labels created the impression that Wahlburgers pickles were unprocessed and free of artificial ingredients, which contradicted the presence of sodium benzoate.
Wahlburgers maintains they did not engage in any wrongdoing. However, to avoid the costs and uncertainties of a protracted legal battle, they agreed to a $2 million settlement to compensate consumers who may have been misled by the labeling.
