TreeHouse Foods has agreed to pay $4 million to settle a class action lawsuit over frozen waffles that were pulled from store shelves due to potential listeria contamination.
The settlement offers refunds to consumers who purchased affected products, regardless of whether they kept their receipts.
The recall, announced in October 2024, covered a wide range of store-brand and name-brand frozen waffles manufactured by TreeHouse Foods. The company produces breakfast items for major retailers across the United States and Canada, meaning the affected products were sold under dozens of different labels.

The popular Kodiak Cakes brand, distributed through retailers like Costco and Kroger, is also covered. Canadian brands including No Name, Selection, Compliments and Western Family are part of the settlement as well.
The lawsuit alleged that TreeHouse Foods failed to adequately warn consumers about the contamination risk before issuing the recall. Plaintiffs claimed they had to discard products they had already purchased and were not properly compensated for their losses.
Listeria is a serious bacterial infection that can cause fever, muscle aches, nausea and diarrhea. It poses particular risks for pregnant women, elderly individuals and those with weakened immune systems.
While TreeHouse Foods has not admitted any wrongdoing, the company agreed to the settlement to resolve the litigation.
The settlement offers different levels of compensation depending on whether you have documentation of your purchase.
Consumers who kept their receipts can claim a full refund for every covered product they bought during the eligibility period. Your receipt should show the product name, purchase price and the date and location where you bought it.
If you no longer have your receipt, you can still file a claim. Households without proof of purchase can receive the average retail price for up to two covered waffle products.
One important note: if you already received reimbursement directly from TreeHouse Foods through the recall process, any settlement payment you receive will be reduced by that amount to prevent double recovery.
The deadline to submit a claim is Dec. 16, 2025, which is also the deadline to opt out or file an objection. A status conference is scheduled for Dec. 12, 2025, at which the court will set the date for the final approval hearing.
