A $4 million settlement has been reached in a class action lawsuit against Old Lyme Gourmet Co., the makers of Deep River Snacks potato chips. Plaintiffs allege that the company’s use of a “Non-GMO Ingredients” graphic on its chip packaging misled consumers into believing the products were certified by a third-party organization, such as the Non-GMO Project.
Old Lyme denies these allegations but agreed to settle the lawsuit to avoid further litigation.

Old Lyme has agreed to remove the “Non-GMO Ingredients” graphic from its product packaging.
Submit a valid claim form by July 28, 2025. Claims must include supporting documentation for proof of purchase, if applicable. Without proof, claims are capped at 10 additional products.
