Boar’s Head Provisions Co. has agreed to a $3.1 million class action settlement to resolve claims tied to its July 2024 voluntary recall of certain meat products contaminated with listeria. According to the lawsuit, the company failed to adequately prevent or detect contamination in some of its ready-to-eat deli products, resulting in the sale of potentially unsafe items to consumers.
Listeria is a dangerous foodborne bacteria known to cause severe illness, especially in high-risk populations such as pregnant individuals, the elderly and immunocompromised people. After the contamination was detected, Boar’s Head initiated a recall on July 25 and expanded it on July 29, 2024.
Consumers allege they suffered financial losses by unknowingly purchasing tainted products that should not have been sold in the first place. Although no admissions of liability were made, Boar’s Head agreed to the settlement to resolve the litigation and avoid continued legal costs.
Consumers with proof of purchase can receive a full refund for each recalled product purchased. For those without proof, the settlement offers compensation based on the average retail price of up to two recalled items per household.
Any prior reimbursement received directly from Boar’s Head will be deducted from the total settlement payment. The settlement applies only to products bought for personal use—not for resale.
This settlement aims to compensate consumers for purchasing potentially hazardous products that were later pulled from shelves due to food safety concerns.
